Disclaimer

1. Hosted Call Centre System

1.1 As part of the NCS hosted call centre system (‘HCCS’), the following services are offered:

(a) Do Not Call Register list washing (‘DNC Washing’);

(b) Data encryption (‘Encryption’);

1.2 The DNC Washing operates as follows:

(a) The Customer is permitted to upload a list of leads and phone numbers (‘List’) into HCCS;

(b) The List is washed and the phone numbers on the list may be dialed for a period of 30 days, after which time they are disabled.

1.3 The Encryption allows the Customer to encrypt recordings and encrypt defined fields such as notes and credit card details which are stored in HCCS.

2. Acknowledgements

2.1 With regard to DNC Washing, you acknowledge that:

(a) this service should only be used as a secondary tool to compliment your own List washing against the Do Not Call Register;

(b) best practice is to undertake your own List washing against the Do Not Call Register;

(c) it is your responsibility to check to ensure that all Lists are used in accordance with the law.

2.2 With regard to Encryption, you acknowledge that:

(a) if the encryption keys are lost for any reason, then the encrypted data may become unreadable;

(b) if HCCS is hacked or otherwise compromised, some data may become readable to a third party;

(c) third party software and hardware may causes weaknesses in encryption schema.

(d) management of the encryption keys is your sole responsiblity and that whilst (at your choosing) NCS may retain a set of encryption keys, NCS does not warant that these keys can be used to recover your Call Recordings or field data, nor that NCS can guarentee the security of any keys held by NCS.

2.3 You agree that the matters you acknowledge in clause 2.1 and 2.2:

(a) are not a defect in service, and you accept our services subject to these matters; and

(b) to the extent permitted by law, we are not liable for any loss or damage arising from any of these matters.

The only way you can ensure the safety of your recordings and fields is to undertake regular downloads of recordings (via the Bulk Download facility) and fields via campaign exports and test that the recordings and fields are intact after each download and then store those recordings and fields in a secure location.
